STATE OF FLORIDA

2009 Session of the Legislature

proposed: A FLORIDA TENTH AMENDMENT POWERS MEMORIAL

A memorial claiming authority under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; providing that certain federal legislation be prohibited or repealed; and directing distribution.

WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”; and

WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, today, in 2009, the states are demonstrably treated as agents of the federal government; and

WHEREAS, many federal laws are directly in violation of the Tenth Amendment to the Constitution of the United States; and

WHEREAS, the Tenth Amendment assures that we, the people of the United States of America and each sovereign state in the Union of States, now have, and have always had, rights the federal government may not usurp; and

WHEREAS, Article IV, Section 4 says, “The United States shall guarantee to every State in this Union a Republican Form of Government”, and the Ninth Amendment states that ”The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people”; and

WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and

WHEREAS a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States.

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF FLORIDA :

THAT the State and the people of Florida hereby claim authority under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.

THAT this serves as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.

THAT all compulsory federal legislation which directs states to comply under threat of civil or criminal penalties or sanctions or requires states to pass legislation or lose federal funding be prohibited or repealed.

THAT a copy of this memorial be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker of the House and the President of the Senate of each state’s legislature of the United States of America, and each member of the Florida Congressional Delegation.

The above memorial proposed for the State of Florida has been adapted from the Joint Resolution (HJR1089) approved by vote of 92-3 in the the Oklahoma House of Representatives in 2008. The 2009 version of that resolution may be viewed here

For Constitutionally Oriented Organizations & Candidates:

How Your Organization or Candidate Can Get Its Message Out to an Interested and Influential Audience at the 2007 Bill of Rights Day Celebration.

This is the first time that we have offered these kinds of opportunities, which we believe will help to promote the Constitution restoration message throughout the South Florida area and beyond. We want to give exposure to the name, message and mission of each group during the course of this event. Following are the revised, more inclusive rules providing publicity for your organization:

Benefits will accrue to organizations and candidates that bring out six or more paid attendees to the luncheon, as follows:

A. Speaking Order:

The first 5 organizations/candidates to fill tables of 10 will be able to speak in the program period immediately prior to the meal. However, if less than 5 organizations reach 10, the remaining spots will be filled by those organizations that first fill 8 seats and then by those that first fill 6 seats. We are working on the premise that the speaking spots closest to the start of the meal will be best. In light of that, the order within the five that get to speak (about how their organization or candidacy will help to restore constitutional government) will be determined first by the initial 10, 8, 6 rankings and then by the number of additional paid attendees who self-identify or whom can otherwise reasonably identify with a particular organization or candidate.

Beyond the top five organizations, speaking opportunities will be provided following the drawings for prizes. Attendees will be encouraged to stay and listen to those additional interesting speakers and to engage in networking and exchange of information.

The cutoff date for purposes of the total count will be December 8 for mail-in ticket purchases and December 10th for on-line ticket purchases. The speaking time will be between three and five minutes and will effected by considerations such as how many speakers need to be accommodated and the necessities for pacing the event.

B. Banner Placement:

Banner placement will be based on a ranking of the total number of paid attendees identified with each organization. The ranking will determine how close to the podium, along the wall behind the podium, each banner will be located. The minimum number of paid attendees to qualify for a banner is 6. The counting for this purpose will continue through December 8 for mail-in ticket purchases and December 10 for on-line ticket purchases. In the unlikely event that insufficient locations are available for banners from all groups that otherwise qualify, the lowest ranking organizations in terms of the number of tickets will be unable to display a banner. We will communicate with you should such a dilemma arise.

C. Listing your organization as an event sponsor:

Organizations with 6 or more attendees will be listed in the program as event sponsors. The order of listing in the program and the amount of contact information included will be based the date upon which you reached the threshold numbers of 6, 8, or 10 luncheon participants and on the number of attendees associated with your organization. Because we need lead time to produce the the printed program, the cutoff date for the data to be used for these determinations will be December 7, or earlier if necessary.

We believe the above sets a reasonable and understandable set of ground rules. The Bill of Rights Day Committee reserves the right to make final decisions in all matters and to make adjustments and improvements as circumstance either require or permit.

8th Annual Bill of Rights Day Celebration - December 15

THE CONSTITUTION COMMITTEE’S 2007 BILL OF RIGHTS DAY CELEBRATION AT THE PALM BEACH COUNTY CONVENTION CENTER WAS ANOTHER MILESTONE SUCCESS. Here are the HIGHLIGHTS:

  • Approximately 90 people were in attendance to enjoy a terrific meal and program.
  • Constitution Committee Founder Lee Coleman, who will be 90 next April, pesented a retrospective on the founding and history of the Constitution Committee, plus some important commentary on the state of freedom in America today.
  • Leaders from The Second Amendment Coalition of Florida (Bill Gorman), The Florida Ballot Initiative (John Parsons), The Dean Santoro Campaign (Dean Santoro), The Constitution Committee (Dean Taffel), We The People of Florida (Dan Gonzalez), and The Ron Paul Citizens’ Campaign (Steven Talcott Smith) each spoke for a few minutes on how the activities of their candidate or organization is furthering the cause of the restoration of Constitutional government. All spoke well.
  • Our guest speaker, Professor Marshall DeRosa, gave us a great education in the originally intended limitation of the jurisdictional scope of the Bill of Rights and how the Bill of Rights was subsequently subtly perverted by those who intended to destroy the sovereignty of the states and centralize all power into a highly socialized INDIVISABLE central government, as exists today. The audience’s was completely attentive throughout Dr. DeRosa’s presentation and the very interesting question & answer session that followed.
  • Constitution Committee Vice-President David Wood was presented with the prestigious Eagle Award from The Eagle Forum for his service to God and Country. The Award was made by Eagle Forum Representative Barbara Susco.
  • I was privileged to receive the Constitution Committee’s 2007 Lee Coleman award, presented by Constitution Committee Founder Lee Coleman.
  • The food, service and facilities were excellent. Our special thanks go to the very helpful staff of the Convention Center and Aramark Catering Services.

Marshall L. DeRosa, Ph.D., is a distinguished scholar and expert on the Confederate constitution. His expertise includes American constitutional law and policymaking, international law, and the judicial process. In addition to this first book with Pelican, he is the author of three books and several journal articles. He is a professor of political science at Florida Atlantic University. He lives in Boca Raton, Florida.
